2. Authorization to Pull Credit and Collect Information
When you submit a request for pre-qualification or an application on the Website, you authorize us to contact any third party, including any credit reporting or database service, your current and prior third-party card processors, and your current and prior banks, so that we may confirm or obtain any information bearing on your creditworthiness or reputation. You also understand and agree that Swift Capital is making no commitment or guarantee that any product, evaluation, or guidance provided by Swift Capital will result in any approval for a business funding solution from Swift Capital or any third party. You are providing "written instructions" to Swift Capital under the provisions of the Fair Credit Reporting Act authorizing us to obtain a credit report or background report. Any such report(s) that Swift Capital obtains may include, without limitation, the business's or your credit history, U.S. Department of Transportation records, any other public records, and any other information bearing on credit standing, credit capacity, or character. Such report(s) will be used by Swift Capital to determine eligibility for a business funding solution. You will also provide and/or execute additional documents Swift Capital may require in order to access and review any tax information related to your business, which may include executing an Internal Revenue Service Form #8821.
Additionally, as part of our approval process in providing our Service, we may use a neutral third party to access your business financial information. Such third party may have its own terms and conditions of use or access.
3. Authorization to Conduct Business Electronically
By using the Website, you consent to: (a) transact business with us online and electronically; (b) receive certain disclosures electronically, either via the Website or an email address provided by you; and (c) receive electronically all relevant documents, communications, notices and contracts related to your business funding pre-qualification, funding request, servicing or collection.

4. Authorization to Contact You
You authorize Swift Capital and its affiliates, agents, assigns and service providers (collectively, the "Messaging Parties") to contact you using automatic telephone dialing systems, artificial or prerecorded voice message systems, text messaging systems and automated email systems in order to provide you with any and all information related to your pre-qualification, request for funding and/or account. You authorize the Messaging Parties to make such contacts using any telephone numbers (including wireless, landline, VOIP numbers and hereinafter developed technology) or email addresses you supply to the Messaging Parties. You understand that anyone with access to your telephone or email account may listen to or read the messages the Messaging Parties leave or send you, and you agree that the Messaging Parties will have no liability for anyone accessing such messages. You further understand that, when you receive a telephone call, text message or email, you may incur a charge from the company that provides you with telecommunications, wireless and/or Internet services, and you agree that the Messaging Parties will have no liability for such charges.
